Strategic land

Our specialist strategic land team acts for both landowners and developers and is aware of the issues faced by both in realising value from their assets and investments.

We are a team with the skills and experience to deal with the whole strategic land process from heads of terms to the planning consent and disposal.

What we do

We act on behalf of clients with regard to all legal aspects of the land and planning process, which they encounter in achieving consent to develop. Our team includes specialists in property, planning, the environment and construction.

In particular, we deal with a range of option agreements, promotion agreements, joint venture agreements and other risk sharing arrangements. We also advise clients on planning, highways and infrastructure agreements, preparation of master plans, compulsory purchase and the running of planning appeals and judicial review claims.

Our experience of the sector allows us to help our clients find appropriate and innovative solutions to the problems they face and to work effectively both with relevant stakeholders and their commercial partners.

  • Acting on behalf of a developer with regard to a site assembly involving the entry into option agreements with over 30 landowners. We also acted on behalf of the developer with regard to a planning appeal with regard to a planning appeal in respect of that site
  • Acting for a developer with regard to the entry into a promotion agreement with a offshore company in respect of a significant landholding. The agreement included both option and pre-emption provisions alongside ones relating to market testing
  • Acting for joint venture partners in developing a new planning gain (section 106 agreement) mechanism to ensure developer contributions for a new 600 home neighbourhood in the south east. This was recognised in a document by Department for Communities and Local Government as a beacon of good practice
  • Acting on behalf of a private landowner with regard to the unconditional sale of land to a housebuilder, including planning promotion obligations and a planning overage
  • Acting for a registered charity with regard to the proposed entry into a promotion agreement and conditional contract with a national housebuilder. The agreement included market testing and our advice extended to the obtaining of charitable consents
