The Court of Protection deals with registration of enduring powers of attorney and lasting powers of attorney, applications to appoint deputies to look after the affairs of the mentally incapable and applications to make wills or gifts on behalf of the mentally incapable. What we do
We produce powers of attorney of all kinds - general powers, trust powers and lasting powers of attorney - as well as advance decisions, also known as living wills. We make applications to register enduring and lasting powers of attorney.
We regularly deal with the Court of Protection so we are familiar with its rules and procedure, including contested applications. Where possible we reach agreement in advance to avoid the need for a costly hearing.
You can ask us to supervise the work carried out by your attorney. This gives you protection if you become incapable and may avoid family arguments.
We also provide practical advice to attorneys and deputies about how to carry out their roles, which gives them protection against criticism. This includes advice about obtaining care in the home, moving to residential care, dealing with tax, obtaining appropriate benefits, and managing finances.
